CAIT ask CCI for search, seizure operation on Amazon & Flipkart

Raipur, Sep 13: CAIT National Vice President Amar Parwani, Chairman Mangelal Maloo, Amar Gidwani, State President, Jitendra Doshi, State Working President, Vikram Singh Deo, Parmanand Jain, Vashu Makhija, State General Secretary, Suriender Singh, State Working General Secretary, Bharat Jain, State Treasurer Ajay Agrawal and state media incharge Sanjay Choubey informed that with a view to speed up the investigation of Competition Commission of India (CCI) against e-commerce companies Amazon and Flipkart, the Confederation of All India Traders (CAIT) in a communication sent to Ashok Kumar Gupta, Chairperson of CCI has demanded to take immediate steps for aggressive investigation into the business module of both Amazon & Flipkart in reference to complaints of dominance, non-competitive business practices thereby killing the competition and violation of rules as stated in Press Note 2 of the FDI policy, 2018 of the Government of India, which are the assisting factor for their dominance in e-commerce business of India.
The CAIT has sought CCI to direct these companies to continue their current business activities strictly as per the rules prescribed in Press Note No.2 or direct them to suspend their operations till the time investigation takes place. To restrain the abuse of dominant position, we also request you to advise the Investigation officer to conduct and search and seizure of all the concerned documents, computers, hard disk and other relevant data. There is reasonable ground to believe that documents or equipment relating to the investigation are likely to be destroyed, mutilated or falsified. CAIT National Vice President Mr. Amar Parwani & State President Mr. Jitendra Doshi said that the ongoing investigation by Competition Commission of India against Amazon & Flipkart which must have gained momentum, after rejection of the appeal of both Amazon & Flipkart for stay of the investigation, by the Supreme Court of India.
However, it looks like that the investigation is being conducted at snail’s speed and in the meantime both these companies are continuing with their business practices which are under the purview of investigation resulting into creation of high uneven level playing field which is adversely affecting the fundamental right to work of the people and traders of India.
If immediate action is not taken, the basic purpose of investigation will be jeopardised and the sermon “ Justice delayed is Justice Denied” will become true.
